(四)甲方应当要求租赁单位严格执行国家、省、市有关工伤事故和职业病报告制度。乙方在工作中，如遇租赁单位的管理人员违章指挥，强令冒险作业时，乙方有权拒绝执行。

五、工作时间和休息、休假

(一)租赁单位安排租赁人员执行____________工时工作制。

1.执行标准工时工作制：每日工作时间不超过八小时，平均每周不超过四十小时。

六、工作纪律

(一)乙方应遵纪守法，遵守租赁单位规章制度，服从管理，爱护租赁单位的财物。如因乙方故意或重大过失给租赁单位造成损失，乙方应依法承担赔偿责任。

(二)乙方应保守租赁单位的商业秘密，未经单位同意，不得非法向外界提供租赁单位的任何文件、资料和其他信息，否则，乙方应当依法承担赔偿责任。

七、工资福利和支付方式

(一)乙方的工资标准由甲方根据乙方岗位工作的性质、要求及难易程度与租赁单位协商确定，并征得乙方的认可。

九、被派遣人员的退还

1.乙方患病或非因公负伤，医疗期满后，不能从事原工作，也不能从事由租赁单位另行安排的工作的;

2.因租赁单位生产经营状况发生重大变化，致使本合同无法履行的;

(三)有下列情形之一的，甲方有权要求租赁单位不得退还乙方：

1.乙方患病或负伤，尚在规定的医疗期内的;

2.乙方系女性在孕期、产期、哺乳期内的;

十、被派遣人员的人事档案关系及户籍管理

(一)甲方依照有关规定，管理乙方的人事关系和人事档案，内容包括：

1.负责人事档案材料的收集、鉴别、清理、归档、保管等工作，按规定负责人事档案的查阅、借用、转递工作;

2.认定乙方参加工作时间、计算连续工龄;

3.为乙方办理转正定级，代办初聘职称，核定、记载档案工资。

4.为乙方代为申报专业技术资格评审(报考);

5.出具以档案为依据的有关证明;

6.管理、接转乙方党组织关系;

7.认定并保留乙方原身份，流动时按国家规定办理流动手续;

8.协助租赁单位对乙方进行年度考核，并将考核结果记入本人档案;

9.办理乙方(大专以上)户籍迁至_______或落入市人才服务中心集体户的迁移手续，并负责乙方的计划生育管理工作;

10.为乙方建立个人诚信档案;

11.其他与档案、户口有关的代理服务。

(二)乙方遵守现行的人事关系、人事档案和户籍管理的有关规定，配合甲方和租赁单位做好管理工作，具体包括以下内容：

1.协助甲方和租赁单位将其人事关系、人事档案转入甲方，以便办理托管手续;

2.乙方因特殊原因不能将其人事关系及人事档案转入甲方的，应配合甲方与其原单位签订借用合同，并提供与档案有关的证明材料，以便为其建立个人临时档案和诚信档案;

3.乙方应向甲方提供户籍所在地证明和计划生育证明材料，并协助甲方和租赁单位做好计划生育管理工作;

4.若乙方在租赁单位特殊岗位上工作(如会计、出纳、营销等)，还需提供担保材料;

5.乙方系党员的，如租赁单位有党组织，应积极参加组织活动，按时缴纳党费;如租赁单位无党组织，其党费缴给甲方党组织。党员还应于每年底向组织关系所在党支部交一份政治思想及业务工作汇报材料，如实反映自己的思想、工作情况。乙方系预备党员的，由甲方或租赁单位党支部按照党章规定为其办理转正手续。

6.乙方应积极参加年度综合考核，并将考核结果送交甲方存档。

十一、派遣人员管理费的分担

(一)乙方的人事档案管理费、户籍管理费和租赁人员管理服务费由租赁单位承担;

(二)乙方办理流动手续的费用由乙方个人承担;

(三)由甲方为乙方代办的单项人事代理业务(如职称评审或职称资格考试等)，费用由乙方承担。

十二、合同续签和解除

(一)本合同期满前，乙方如愿意续签合同，至少应当提前30日以书面方式向甲方提出。

(二)如租赁单位通知甲方不再租赁乙方，本合同终止，乙方到甲方办理解除合同的手续。

(三)如甲方主管部门要求不再开展人才派遣业务，甲方应提前通知乙方，本合同解除。

(四)如甲方违反本合同的规定，乙方可以要求解除合同。

(五)因不可抗力事件致使本合同无法履行时，双方协商解决本合同的善后事宜。

十三、违约责任

(一)甲方在合同期内无故辞退乙方，应按合同未履行的期限根据约定的工资、保险费标准依法承担赔偿责任。

(二)乙方如未履行本合同约定的义务，给甲方、租赁单位造成损失的，应当依法承担赔偿责任。

十四、争议处理

甲乙双方因履行本合同发生争议，应通过协商解决;协商不成的，可依法向市人事(劳动)争议仲裁委员会申请仲裁;对仲裁裁决不服的，可依法向人民法院起诉。

十五、其他约定

(一)乙方与甲方解除或终止派遣合同之前，要与租赁单位办理好工作交接手续，持租赁单位通知单，到甲方办理相关手续。

(二)乙方在解除或终止合同后 个月内，应保守租赁单位的商业秘密。

(三)乙方与甲方解除或终止本合同后，可以向甲方申请派遣新的单位，也可通过人才市场自主择业。

(四)本合同未尽事宜经双方协商一致，可以签定补充合同，与本合同具有同等效力。

(五)本合同一式叁份，甲、乙和租赁单位各执一份，自签字之日起生效。
