工作者队伍计划之律师及法律服务工作者队伍警示教育活动实施意见

为进一步规范全县律师及法律服务工作者的执业行为，强化职业道德与执业纪律，局党组决定，结合正在开展的“忠诚、为民、公正、廉洁”为主要内容的核心价值观教育实践活动，在全县律师及法律服务工作者队伍中开展警示教育活动，现提出如下实施意见：

、指导思想

高举中国特色社会主义伟大旗帜，以邓小平理论和“三个代表”重要思想为指导，深入贯彻落实科学发展观，通过学习教育，使广大律师深刻认识个别律师、法律服务工作者违纪违法的严重危害，深刻认识做中国特色社会主义法律工作者的本质要求，自觉践行中国特色社会主义法律工作者的职责使命，自觉坚持党的事业至上、人民利益至上、宪法法律至上，自觉坚持拥护党的领导，拥护社会主义制度，拥护宪法，切实做到依法执业、诚信执业、尽责执业，切实做到维护当事人合法权益、维护法律正确实施、维护社会公平和正义，为建设和谐平安提供优质高效的法律服务。

二、开展警示教育活动的意义

开展警示教育是认真汲取康仁兵案件深刻教训、引导律师依法正确履行法律服务职责、切实维护社会和谐稳定的迫切需要，是律师工作深入贯彻落实“忠诚、为民、公正、廉洁”为主要内容的核心价值观教育实践活动，积极发挥职能作用的实际行动。各律师事务所和法律服务所一定要充分认识开展警示教育的重大意义，精心组织、周密安排，确保活动取得实效。

三、开展警示教育活动的目标

(一)全县律师践行中国特色社会主义法律工作者的自觉性进一步坚定，全县律师依法执业、诚信执业、尽责执业的观念得到进一步增强。

(二)完善全县律师诚信执业信息档案。建立律师不良执业行为档案及律师和律师事务所失信和处罚的信息公开披露制度，主动接受社会监督。

(三)加强与司法机关的沟通联系，建立律师与司法人员互相监督机制，进一步规范律师与司法人员相互关系。

(四)进一步完善律师执业监管、违法违纪投诉查处制度，规范查处流程、明确查处期限、建立投诉查处考核机制，坚决纠正律师行业中的不正之风，坚决查处律师执业中损害当事人利益的不法行为，做到“应查必查，应处必处”。对律师和律师事务所的日常监督形成长效机制。

(五)律师事务所的管理得到进一步加强，内部管理制度进一步健全完善，所内运行程序切实规范，“散、乱、差”的律师事务所得到全面整顿和清理。

(六)进一步拓展律师工作，加强与相关政府部门、社会机构的联系与协调，进一步改善律师执业环境。

四、开展警示教育活动的主要内容

警示教育要重点围绕以下四个方面开展：

(一)加强学习。在律师队伍中深入开展思想政治教育和法律法规、职业道德、执业纪律教育，组织广大律师认真学习宪法、法律，认真学习社会主义法治理念，认真学习《律师法》及相关法规、规章、行业规范，认真学习《律师职业道德和执业纪律规范》。通过学习，统一思想，提高认识，进一步增强广大律师的宪法观念和严格依法规范执业的意识，提高律师维护宪法和法律权威，维护当事人合法权益、维护法律正确实施、维护社会公平正义的自觉性;进一步增强广大律师的职业道德水准和执业纪律观念，努力在执业活动中实现法律效果与社会效果、政治效果的有机统一。

(二)深入讨论。通过揭披个别的违纪违法情况，组织广大律师深入剖析个别违纪违法的原因，认真总结教训，并结合我县律师工作实际，重点围绕“如何坚定不移地做中国特色社会主义的法律工作者、经济社会又好又快发展的服务者、当事人合法权益的维护者、社会公平正义的保障者、社会和谐稳定的促进者”，“如何切实履行维护当事人合法权益、维护法律的正确实施、维护社会公平和正义的职责使命”、“如何在执业活动中努力

四、养成洁身自好和谨言慎行的生活作风

在全县安全稳定工作警示大会上的讲话

同志们： 近段时间以来，中、省、市各级多次召开紧急会议，对抓好安全生产、维护社会稳定提出了明确要求，11月12日，我们也召开了专题会议，对全县安全稳定工作进行了安排部署。今年，我县安全生产总体上运行平稳，但问题还客观存在；近期情况来看，安全事故有所反弹，形势依然严峻。今天召开的警示教育会，目的就是吸取教训，查找不足，加强措施，避免悲剧重演。特别是要迅速采取有力措施，抓好元旦、春节期间的安全生产工作，确保全县人民“两节”平安。下面，我讲四点意见。 一、形势有喜有忧，丝毫不能麻痹 （一）总体形势平稳。今年以来，县委、县政府高度重视安全生产工作，各级各部门配合密切，相关单位监管有力，深入开展了以13条线为重点的安全生产专项整治、重大隐患的排查整改，安全生产责任制和责任追究制得以落实，有效防范和遏制了重、特大事故的发生。截止11月底，我县共发生统计上报事故40起，死亡14人，受伤48人，经济损失45万元，与去年同期相比，事故件数与死亡人数同等，受伤人数下降20%，经济损失上升50%，四项指数一升二平一降，死亡人数占市政府下达控制目标的66%，全年安全生产形势总体上较为平稳。 （二）问题非常突出。认识安全生产要多讲问题，少谈成绩。目前，我们工作中的问题还不少。一是重视程度不够。县委、政府对做好安全稳定工作提出了严格要求，并进行了多次强调，但个别同志对安全生产重视程度还不够，安全生产这根弦还没有真正绷紧，个别基层领导执法理念还不深入，工作不真抓、不会抓、不敢抓、不愿抓的现象十分突出，这已成为安全生产工作的最大隐患。二是安全意识不强。安全意识淡漠，把关不严、心存侥幸的现象还十分普遍。从10月9日新县城安装干道下水管道安全事故的调查看，施工单位不具备安装资质，驾驶人员无证驾驶，从业人员违规操作，从施工单位、现场监理到具体操作人员，连最起码的安全生产意识都不具备，何谈安全管理？如何保障安全？三是制度落实不好。在我县的部分地方，安全生产的各项制度还流于形式。12月4日市上暗访组在三河镇暗访时发现，被访的18只船中，没有一只落实了监管和签单制度，其中6只还出现超载，这种情况让人震惊。这些制度我们都三令五申，为什么难以落实？是执行力差落实不了，还是另有隐情不愿落实？这值得深思。四是隐患整改不力。近段时间以来，安监部门对安全隐患实行了挂牌整改，但整改落实没有全部到位，安全死角还大量存在。前段时间，安监部门请专业安全评估公司对我县68家页岩砖厂进行了勘验评估，其中有53家存在安全隐患，新政镇的18家企业只有两家符合生产条件，更有甚者，竟有10多家无牌无证的黑企业，这种现状令人寝食难安。本月15日，我在下乡时发现：一台破旧的拖拉机在陡峭的山路上跑掉了前轮，所幸未酿成事故，一条小船载客30多人在浓雾中横江而渡，随行的同志告诉我船在准载范围。他们有没有合法手续？我们的安监制度坚持没有？类似情况还有多少我们没看到？这都是些让人胆战心惊的问题。 （三）教训十分深刻。安全生产的教训是血的教训，代价十分高昂。我们要从前面通报的几起事故中吸取教训，深刻反思，自觉从主观上、从领导和工作方法上查找原因。一是要反思“责任重于泰山”的安全意识树牢没有。对安全生产思想上的侥幸心理有没有，工作上的时紧时松现象是否存在。二是要反思关键环节的责任落实到位没有。各项安全制度和责任有没有全面落实到企业、岗位和人头，安全生产工作是否还存在断档脱节的问题。三是要反思官僚主义作风克服没有。看我们是否按照县委、政府的安排部署抓好了落实，工作中还有没有走过场的现象。以会议落实安排、用文件落实部署的现象是不是彻底得到纠正。四是要反思管理和监控上的漏洞堵住没有。对事故隐患的及时发现和处置上，有没有一套行之有效的方案，在防范事故发生上，有没有采取经常性的过硬措施。五是要反思惨痛的教训吸取没有。对一些安全事故是否存在看热闹、抱着事不关己的态度，是不是真正能做到举一反三，吸取别人教训，整改自身不足。 二、明确政治责任，深化认识问题 安全生产的重大意义怎么讲都不过分。但直白地讲，对领导干部而言，这首先是人命关天的大事，更是确保一方平安的政治责任；作为领导干部，抓大事，尽责任，这是最起码的要求。抓好安全生产，树立意识是前提，落实制度是要害，成败关键在领导。我看，当前最要紧的是从“领导”这个关键上进一步深化认识。 （一）重不重视安全生产是领导干部政治上强不强的表现。安全生产不是一般性的工作问题，而是一项严肃的政治问题。在和平建设时期，安全生产事故是广大人民根本利益的最大威胁。作为执政一方、守土安民的各级领导干部，我们只有站在人民群众根本利益的政治立场上，把安全生产工作放在重要位置，杜绝损害人民群众利益的安全事故发生，才能真正做到执政为民，取信于民，保持党同人民群众的血肉联系。如果连老百姓的生命财产安全都无法给予保证，我们的一切工作都是一句空话。因此，要把重不重视安全生产作为衡量领导干部政治上强不强的重要标准。 （二）安全生产意识强不强是领导干部顾不顾全大局的表现。当前大局是什么?就是抢抓机遇，乘势而上，集中全力完成总书记嘱托，背水一战实现“大变化”目标。如果我们领导干部安全生产意识不强，安全隐患突出、安全事故频发，这不仅直接造成的人员伤亡和经济损失难以弥补，而且会耗费掉大量的人力、物力、财力，分散我们抓发展的精力。从发展环境上讲，良好环境首先是平安环境，安全生产无保障，不能给人以安全感，谁敢来投资兴业。当前的机遇来之不易，我们一定要倍加珍惜，如果酿成重大事故，造成恶劣影响，这对今天的良好局面甚至未来的前途命运都将是致命打击。因此，各级领导一定要站在维护全局、推动发展的高度，牢固树立“安全生产无小事”的意识。 （三）抓不抓安全生产是领导干部尽不尽职的表现。安全生产是各级领导干部的重要职责。从政治上讲，每个领导干部既要对党负责，又要对人民负责。对党负责就是要坚决贯彻执政党的方针政策，把安全生产工作落到实处；对人民负责就是要千方百计保证人民群众的生命财产安全。从岗位职责上讲，安全生产是领导干部的天职，是对领导干部在其位、谋其政的必然要求。从人格道德上讲，不重视安全生产就是草菅人命、麻木不仁。作为领导干部，就应该以崇高的人格、爱民的情怀，勇担安民保民之责，将人民群众的安危时刻放在心上。 （四）能否抓好安全生产是领导干部能力强不强的表现。愿不愿抓、敢不敢抓、会不会抓安全生产，也是检验领导干部能力强弱的一个重要尺度。事实证明，工作抓得主动、安排部署周密、督促落实有力的地方，安全责任事故就少，说明那个地方领导干部头脑清醒，组织能力强，工作方法对。一个安全事故频繁发生的地方，虽不能说那里的领导班子、领导干部有严重问题，但起码可以说领导班子凝聚各方力量、解决复杂矛盾的能力不够，工作到位不好，执行能力不强。 三、强化保障措施，确保落实到位 措施不过硬，安全就没有保证；措施不落实，事故就难以避免。因此，我们必须在措施落实上做到“四个到位”。 (一)责任落实到位。安全生产是一项综合性工作，必须发挥各级各部门领导班子的整体功能，加强协调配合，实行联动和互动。一是形成纵向到底的责任体系。从县、区、乡镇党委、政府，一直到村党支部、村委会、企业，都要逐级落实安全生产责任，层层分解，各负其责。二是构建横向到边的责任网络。各级各部门要按照“谁主管，谁负责”的原则，结合本地区、本部门、本行业实际，把安全生产责任制和各项具体措施落实到负有安全生产责任的岗位和人头上去，具体落实到每一辆车、每一条船、每一个人，逐车、逐船、逐厂、逐个建设工地签订责任书，确保防汛、交通、矿山、消防、施工、旅游、学校等各个方面、各个领域的安全。 (二)基础工作到位。基础不牢，地动山摇。要坚持“安全第一，预防为主”的方针，针对安全生产的新形势、新特点、新问题，重基层、打基础、强监管，健全制度，硬化措施，在安全防范和隐患治理上下功夫。一是完善制度。坚持完善安全监督员制度、安全警示制度、巡回检查制度，使各项安全制度成为经常性的行动和具体细致的工作措施，落实到安全生产的每一个环节，有效防止安全事故发生。二是抓住重点。对重点地区、重点行业、重点单位、重点隐患必须落实安全生产责任，实施重点监管，严防死守，确保万无一失。三是搞好防范。定期组织深入细致的安全检查，确保安全隐患能及时发现，迅速处置，把安全事故消除在萌芽状态。尤其是各建设工地、水上交通等，要做到随到随查，发现问题就地整改。 (三)安全投入到位。没有必要的投入，再多的措施都是空话。一是急需资金要到位。在安全上该花的钱一定要花，没有必要讨价还价，必要的资金需求要保证，绝不能痛小钱、酿大祸。二是技术手段要管用。要采用先进、有效的安全设备和技术手段，真正做到有效防范，决不能用一些陈旧的、简陋的东西来搪塞，部门把关不严或徇私舞弊的，坚决严肃追究。三是人力准备要到位。要督促各业主在安全生产的监督、检查、预防、救护的人力上保证到位，落实专人负责，加强专业培训，岗位和人员不能当摆设。四是预案设置要充分。要制定事故抢险预案，平常进行演练，做到在发生突发事故时能够应付自如，最大程度地减少损失。 (四)检查督促到位。一是领导要亲临一线。各级领导干部要按照分线负责的原则，沉下去，定点包片，分片负责，亲自带队深入一线，检查和发现安全生产存在的问题，落实隐患监控和整改责任制。尤其是对那些平时认为最安全的地方，不可走马观花、掉以轻心。二是要加大执法力度。要整合各执法队伍力量，实行综合执法，加强安全监督管理执法工作，对不符合安全生产条件的单位和业主严厉处罚，重点解决安全意识淡薄、管理薄弱、投入不足等问题，强力整治隐患。该关闭的企业要无条件依法关闭，该停业整顿的要采取停水、停电、停止一切生产资源供应强行整治。三是要抓到具体环节。检查督促工作绝不能走过场，出现形式主义，要多采用暗访的手段，查到具体环节，把隐藏的问题暴露出来，把暴露的隐患整改到位。12月21日，发生火灾的湖南常德桥南市场，是97年以来就存在的安全隐患，今年3月湖南省政府挂牌强力整改，而大火却在整改验收前10天发生了，这场大火怵目惊心，这种教训十分深刻。每一起事故的背后，都很容易看到“人祸”的影子，隐患为什么能长期存在？表面看来是执行太难，根本的原因是执行力太差。我们安全整改的“令箭”变“鸡毛”的事有没有？只管“我检查过了”，不问“他是否改了”的事有没有？这些问题必须高度警醒，坚决纠正。会后要由安监局牵头对安全隐患进行整改，督查办督查整改落实情况。 四、严肃安全纪律，不搞下不为例 要坚持安全生产“四不放过”的原则，逗硬落实 “问责制”和“一票否决制”等各项制度， 严肃纪律，严明奖惩。宁肯今天掉泪，也不明天流血。 (一)领导安全生产工作不力，造成类似重特大责任事故的地方，不论你抓其他工作水平有多高，不论你干其他工作业绩有多显，也不论你原因有多特殊，都将按照有关规定给予党政领导以严厉的党纪、政纪处理。事故后果特别严重造成恶劣影响的，对主要领导还要给予降职使用或者责令引咎辞职乃至撤职的处分。 (二)各级、各行业安全监督管理部门不切实履行法定职责，不按法定程序或有关规定审批、检查，把关不严甚至弄虚作假的，一经发现，对单位给予黄牌警告，对有关人员降职调离。由此而造成重特大安全生产责任事故的，对部门的负责人一律给予撤职处分，对直接责任人一律予以辞退或者开除；对上级直管部门，县委将建议给予相应处理。 (三)业主忽视安全生产投入，生产条件不达标的，一律停业整顿。经整顿仍不达标的，一律吊销营业执照。同时，追究行业主管部门的领导责任。对违规转包工程造成重大事故的，除追究其相应责任外，还要将企业驱逐出，并列入“黑名单”。 (四)一旦发生安全事故，坚决按照“四不放过”原则，加大查处力度，查清事实，分清责任，严肃处理。不仅要追究直接责任者，还要追究领导者，对发生的重特大事故，不仅要追究党纪、政纪和经济责任，还要追究有关法律责任。 八、甲方的责任：

party a’s obligations:

8.1 甲方须按时将出租房屋及其家私家具用品与其设施以良好状态交付乙方使用。

party a shall deliver on schedule to party bvacant possession of the leased property including the furniture,furnishing and appliances and the related facilities for party b’s use(furniture,furnishing and appliances to be detailed in appendisl.)

8.2 租赁期内甲方不得收回出租房屋(除非本合同另有规定)，甲方保证乙方可不受干扰的享用该物业。

party a shall not repossess the leased property during the term of party a disturb of interfere with party b’s quiet enjoyment of the leased property.

8.3 在乙方遵守本合同的条款及支付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

九、乙方的责任：

party b’s obligations:

9.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。

party b shall promptly pay all rent ,security deposit and other charges payable by it in accordance with the terms of this agreement.

9.2 乙方应爱护使用出租房屋，如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏(正常损耗除外)，乙方应负赔偿责任。

paryt b shall treat the leased property with care. if as a result of party b’s negligence or misconduct, the leased property and the related facilities and accessorties suffer any damage(fair wear and tear excepted ),party b shall be responsible for compensating party a for such damages.

9.3 乙方应按本合同的约定合法使用出租房屋，不得擅自改变使用性质，不应存放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。

9.4 未经甲方事先书面同意，乙方不得将出租房屋转租或租给其他的第三者。

十、违约处理：

breach of agreement :

10.1 甲、乙任何一方如未按本合同的条款履行，构成违约，应承担相应的违约责任。双方同意违约方应赔偿守约方之直接损失人民币____________元。

c.无故拖欠租金超过三天(除双方就本合同存在争议除外)。

fails to pay rent without any reason for more than thirty (30)days after the due date except where there is a dispute in respect of this agreement.

十一、适用法律：

3.3 royalty at the rate of_________% (_________percent ) shall be calcuated interms ofnet selling price after the contract products are sold in this year，the contractproducts which not sold shall not be included.

3.4 the report of the selling quantity， net selling amount of the contract productsandroyalty which should be paid in last year shall be submitted to party b in writtenform by party a within 10 (ten) days after the date of settling accounts to royalty. thespecific methods which calculatenet selling amountand royalty are detailed in appendix 3to the contract.

3.5 the contract products sold by party a pursuant to the patent license hereingranted shall be deemed to have been sold when paid for.

3.6 if the contract products are returned or allowances made thereon after the royaltythereon has been paid party a shall be entitled to take ppropriate erdit for suchoverpay-mentagainst royalties thereafter accruing.

3.7 if party b demand to audit the accounts of party a，it shall no tice party a withinl0(ten) days after receiving the written notice of party a in accordance with article

3.4 of the contract.the speeific content and procedure of auditing accounts aredetailed in appendix 4 tothe contract.article 4 couditions of payment

4.1 royalty stipulated in section 3 to the contract shall be effected by party a toarty bthrough the bank_________(here it is the business bank of party a， and the bank_________(here it is the busines bank of party b)， payrnent shall be settled in_________.

4.2 party b shall immediately issue the related documents ofter receiving the writtennotieesubmitted by party a in accordance with artiele 3.4 of the contract， the royaltyshall be paid by party a to party b within 30(thirty) days after party a has received thefol-lowing documents whichare provided by party b and found them in confoumity with thestipulations of thcontract.

（1）four copies of the statement on calculation of the royalty;

（2）four copies of the commercial invoice;

（3）two copies of the sight draft.

4.3 party a shall have the right to deduct from any of the above mentioned payment theppenalties and/or compensations which party b shall pay in accordance with thestipulations ofthe contract.article 5 technical service and training

5.1 technicgl service

（1）during the validity period of the contract， party b shall send a specialist topartya`s factory to explain the drawings and technical documents and to provide teehnicalservise indesigning.manufacturing， adjustment，inspection and maintenance of thecontracted pro-duet so to eheble party a to use， as fast as possible， home materialsand raw components without affeeting the properties of the products so manufactured.

一、加强领导，强化管理，使“安全月”工作稳步推进。

领导重视，建立一套得力的安全管理队伍。成立了以校长任安全领导小组组长，、为副组长，领导小组成员为各班主任。形成一套安全管理网络。

其次，进一步完善安全制度。使安全管理制度更加科学、合理、规范、易操作。学校安全工作领导小组和各班班主任签订安全工作现任状。建立了各项安全工作检查评比制度、安全工作管理制度。实行领导安全值日检查制。值周领导对每天的安全工作负总责，领导小组成员依表值日。

(3)食品卫生安全：教育学生不到外面的摊点上购买零食、饮料等，防止病从口入，毒从口入。

(4)活动安全：加强课外活动及课间活动的安全教育。

(5)行路安全：强化交通法规教育，组织学生观看交通安全教育警示片。

二、开展丰富多彩的活动，将安全意识深入人心。

我们利用各种会议对师生进行安全重要性地教育。利用广播对安全知识，以及与安全方面是和人进行表扬与批评，通过广播，学生学到了许多安全常识，感受到了安全的重要性。黑板报、学习园地等更是学生宣传安全的主阵地，全校出了以安全为主题的黑板报，在校园处处都能感受讲安全的气氛。

为了提高学生学安全、讲安全的积极性，我们还举办了安全知识讲座，在此期间我校开展了“防震减灾”演练活动。寓安全教育于活动中，加强安全教育，提高安全意识，养成安全习惯。
