Confucius Temple is a temple built by later generations to offer sacrificesto Confucius. It was built in the second year after Confucius died. 1、甲方推行“独立经纪人合作制”的经营模式，即甲方与乙方由传统的雇佣关系改变为合作关系，乙方可自愿申请解除劳动关系，办理离职手续后，再与公司签订合作协议，而工资由原来底薪加提成的模式，改为无底薪高提成的激励机制。

2、乙方以独立经纪人身份与甲方合作。乙方使用甲方办公场所、电脑网络、电话等办公条件及楼盘资源、客户资源等信息资源，并以甲方名义开展房地产经纪及一切相关业务。

3、甲乙双方约定合作期限自本协议签订之日起____年为限。

二、分成计算、给付方式、给付时间

1、甲乙双方约定每笔成交单实际收到佣金扣除非本人盘源方、钥匙方、合作方、按揭费等其他分佣后所剩佣金为乙方个人实收佣金(以下简称实收佣金)。

三、甲方的权利和义务

1、甲方免费为乙方提供开展业务的办公场所、电脑网络、电话等办公条件及楼盘资源、客户资源等信息资源(不提供笔、本、计算器、等日常个人办公用品)。

2、甲方根据乙方需要组织开展房地产经纪及相关业务知识培训，甲方有义务为乙方办理当地政府部门所要求的经纪人资格认证报考、培训、发证等事宜，相关费用由乙方承担。

3、在条件允许的情况下，甲方应积极为乙方提供一切广告、信息资源支持，并协助乙方开展业务。

4、甲方有权随时了解乙方业务进展情况，并要求乙方随时汇报。

5、甲方有权干预、阻止乙方违反甲方业务操作流程、服务标准的行为，并对所造成损失要求乙方赔偿。

四、乙方的权利和义务

1、乙方在合同期间所获得所有客户、楼盘信息等资源均须登记在甲方资源管理系统或登记本(册)上，并按甲方规定享有所登记楼盘、客户资源成交后的分佣。

2、乙方进行业务时必须遵守甲方有关规定及客户服务标准。

3、乙方开展业务时不能做出有损甲方品牌形象和声誉的行为，并在进行业务时不得有损害客户及甲方利益的行为，不得吃差价，因前述情形给甲方带来的品牌形象损害和经济损失，甲方有权要求乙方赔偿，并有权从分成中扣除。

4、乙方在甲方所接受的培训内容及讲义、内部文件、内部规章制度、乙方进行业务时所使用、获知的所有客户、楼盘等信息资源均为甲方机密，不得以任何形式泄露，未经甲方书面许可不得提供给第三人及用于其它任何用途。

5、乙方须遵守甲方管理制度及相关规定。甲方制定的规定和限制，与本协议内容不一致的，乙方可提出书面异议，否则视为同意，双方不另行签订协议。

6、乙方所成交售单过户按揭手续须在甲方服务部门或指定合作机构办理，未经甲方书面许可私自找外部机构办理的，甲方有权扣除乙方该单所有收益，如因甲方服务部门或指定合作机构过错造成该单产生纠纷的，由甲方服务部门或甲方指定合作机构承担损失。

五、协议变更、终止、违约责任

1、合作期限内如乙方未经许可私自收取红包、好处费、佣金等，甲方有权单方终止协议，并扣发乙方所有未支付分成及预留保证金作为违约金。

2、乙方如因违规操作被办公地点所在地政府管理部门通报或处罚，则本协议自行终止。

3、乙方因违反甲方制度规定，使甲方受到损害的，甲方有权单方终止本协议。

4、乙方因故连续____天(含)以上无法开展业务，未向甲方管理人员通报，甲方有权单方终止本协议，并暂停发放所有未发放分成，直至交接清楚后予以发放。

5、合作期限内如需变更协议内容由双方协商确定。因不可抗力的原因，使协议无法完全履行或部分无法履行，经双方协商，可以变更、修改或终止本协议。

一、完善资料，规范档案管理

二、定期排查，促进调解工作

一、强素质，注重业务知识学习。

为了提高社区司法工作人员和人民调解员的工作能力和业务素质，促进对政策法规的理解，高家司法所坚持每月组织学习业务知识，学习先进的工作经验，通过学习，使基层司法工作人员明确了法律知识、了解司法行政工作的近期工作任务，同时也促进了各社区工作人员之间的交流和沟通。

二、树形象，做好普法宣传工作。

三、抓基础，做好人民调解工作。

我们始终把辖区矛盾纠纷排查调处作为司法所工作的重点，全面开展社会矛盾纠纷排查调处工作。我所经常性开展矛盾纠纷排查，每月召开矛盾纠纷分析例会，提高调解员对纠纷的调处能力。根据市司法局的统一要求，进一步规范了纠纷调解报表，并做到及时、准确上报调处情况。上一年，司法所采取定期或不定期的方式6次深入到各社区进行排查、调处矛盾纠纷，共排查受理各类民事纠纷64件，调解成功62件，其中邻里纠纷43件，婚姻家庭纠纷20件，劳务纠纷1件。把矛盾化解在基层，有力地维护了高家辖区的和谐稳定。

四、有重点，落实“六调联动”工作机制。

按照区委政法委和区司法局的工作要求，不断完善“六调联动”体系，落实“三横三纵”调解工作运行模式，推动联动调解机制向社区延伸。

一是强化意识。3月23日，司法所组织辖区人民调解员、社区民警、调访信息员和义务巡逻队成员，成立了综合调处室，制定了综合调处工作例会制度，即每两个月召开一次综合调解工作会议，由司法所主持召开，及时对前一阶段的工作进行总结。通过宣传、讲解，每个成员都充分认识调解工作的重要性，增强了做好人民调解工作的责任感和紧迫感。

二是形成网络。通过居民推选出20名热心人民调解工作的社区居民担当义务调解员，成立了“远亲不如近邻”群众调解队，负责各社区的矛盾纠纷调解、上报工作。3月16日，卧里屯司法所邀请群众调解队的义务调解员、社区警务五队队长、街道妇联主席及社区调委会主任召开“群众调解之家”座谈会。群众调解队建在社区，有利于紧密配合社区调委会、司法所工作，及时有效地化解居民纠纷，维护辖区稳定。

20xx年, 稽查大队认真贯彻县局要求，强化各项工作措施，坚持“以打开路、以管为主、以服务为先”的指导思想，各项工作稳步开展，各项目标任务基本完成部分任务还超额完成。截止11月稽查大队带领全体稽查人员，累计查案233起，查获“三烟”48.8件，案(标)值20.86万元，查获“三烟”数量完成全年目标任务50件的97.6%;办理无证经营案件41起，完成全年目标任务40起的102.5%;查处违规户167户，完成全年目标任务180户的92.8%;不法烟贩被拘留12人、判刑3人，分别完成全年目标任务10人、2人的120%和150%;侦办网络案件3起，完成全年目标任务3起的100%。一起在*本地市场侦办的网络案件已进入收网阶段。

一、集中整冶重点市场。

今年局稽查大队加强与公安、工商等职能部门的联系、配合。合力集中整治辖区重点市场。

㈠承接去年x月x日起开展的百日专项行动。年初至2月底，开展了百日行动第二、三阶段的整治行动。一是摸排情况，有的放矢。及时梳理市场情况和动态，做到有针对性地进行检查和管理;二是分组分工，各有侧重。联合执法队兵分三路，一组

负责道路稽查，重点对全县车站、码头及交通要道的重点路段实施巡查，二组负责市场清查，白天整市场，晚上查宾馆、酒楼及娱乐场所，三组负责重点监控，对重点经营户轮班实行24小时盯守;三是严格管理，依法行政。百日专项行动期间，不法分子暴力阻碍执法事件时有发生，但专卖稽查人员始终坚持文明执法，冷静地处理好每起暴力抗法事件，树立了烟草专卖执法为民的良好形象。

㈡2月x日至4月x日，开展了中心城区集中整治行动(A)，并将整治范围从*市场部辖区扩大到全县。A行动末期，结合净化五一节前市场工作，开展了一系列集中整治活动，一是于4月x日晚开展了公共复杂场所整治行动。县烟草、公安、工商三部门联合行动，对县城城区宾馆、酒楼、洗浴中心、OK厅、网吧等公共复杂场所进行了突击检查，查处违规经营卷烟的业主3户，查获非法“三烟”3.7条，案值750元。二是于4月x日开展了端窝点行动。在掌握了可靠信息的情况下，对*管理所辖区经营户吴某的门店及仓库进行了突击检查，现场查获非法“三烟”100条，案值1400元。

㈢2月x日至28日，按照全市统一部署，组织开展了卷烟零售市场集中整治行动。行动中，大队同公安、工商等职能部门及各乡镇政府密切配合，协调动作，工作时间上打破常规，多采取下班时间突击检查或白天检查后晚上再“杀回马枪”的工作安排，打击实效性有所提高。

㈣3月x日至4月x日，与县公安局联手开展了为期一个月的烟草市场集中整治行动。集中行动围绕拘留涉烟违法犯罪分子1人、捣毁销售藏匿“三烟”窝点12个的工作目标，从摸排涉烟案件线索、组织违规户警示谈话及清查公共复杂场所三方面入手，迅速扭转了非法“三烟”反弹、主渠道销售不振的被动局面。

㈤5月x日至4日，开展了第二次卷烟打假市场整顿专项行动。共出动执法人员40人次，检查零售户141户，查案2起。

㈥6月1至30日，开展了中心城区集中整治行动(B)。在集中整治行动指挥部统一协调下，各职能部门既密切协作，又各有侧重。大队主要开展五项工作，一是和交警部门对客、货运车辆进行检查，二是和治安部门对酒店、宾馆、娱乐场所开展整顿，三是组织人员对重点户、重点场所实行24时监控，四是对乡镇零售市场各进行2次集中整治，五是做好行动期间宣传报道工作。

㈦8月x日至9月x日止，在县城城区及*市管所辖区开展了卷烟市场集中整治行动(C)，9月x日至29日，开展了20xx年第三次全县卷烟打假市场整顿专项行动。

㈧11月x日开展荆州中心城区及周边地区集中整治行动

(D)我县城关市管所被纳入集中整治行动范围，稽查大队再次把工作重心放在*城区市场，在D行动开始的第四天稽查大队就会同*县公安局*派出所在我县城区市管所所辖的*市场成功端掉

一个窝点，现场查获非法“三烟”773条案值2.6万余元。历次集中行动的开展，保持了市场整治工作的连续性，也保持了严打涉烟违法犯罪的高压态势。

二、狠抓经营案件工作不放松。

1、成立经营案件工作专班，加强同本辖区各个派出所联系，培养线人，收集案件线索，并对收集到案件线索进行梳理分析，并分组展开跟踪调查。

2、对全体队员，明确了两条硬性要求，一是必须做好每起案件的保密工作;二是必须将盯守时发现的情况及时向领导汇报。

3.通过一年的艰苦努力，20xx年局稽查大队主要侦办了以下案件：

㈠.20xx年x月x日晚21时左右,经过一个多月的跟踪调查*县烟草专卖局稽查大队成功破获一起以张*为首的团伙销售假烟案。端掉1个窝点，查获假烟红玫瑰雪茄烟3300条、狮王雪茄烟2250条,合计品种2个假烟5550条,标值3.93万元，涉案总金额14.58万元, 目前张*、彭*两人已被*县人民法院分别判处有期徒刑一年，并各处罚金20xx0元。张*、彭*的*省*市上线万*也于20xx年x月x日被*警方抓捕归案，案件正在审理深挖中。

㈡.20xx年x月x日，*县烟草专卖局稽查大队在*县公安

局治安大队协助下，成功破获一起以杜*为首的非法经营假烟案，现场抓获犯罪嫌疑人2人，随后端掉窝点1个，查获假蓝软黄鹤楼97条、软白沙73条、兰盖芙蓉王13条，合计卷烟183条，案标值2.13235万元，还查获销售账本及汇款单据，涉案总金额10.84165万元，目前已刑拘3人，主犯杜*于20xx年x月x日被*县人民法院以非法经营罪，判处有期徒刑一年，并处罚金10000元。

㈢.20xx年x月x日，*县烟草专卖局稽查大队在*县公安局治安大队协助下，成功破获一起非法经营卷烟案，现场抓获犯罪嫌疑人2人，查获违法车辆1台，从车号为*的柳州五菱微型面包车上查获盖珍品黄鹤楼165条、软珍品黄鹤楼2条、盖楚韵论道黄鹤楼38条、软楚韵论道黄鹤楼6条，合计4个品种卷烟211条，案标值6.2260万元。涉案总金额7.3960万元，目前已刑事拘留2人。

㈣.20xx年x月x日局稽查大队在*县公安局*派出所协助下，一起在*本地市场侦办的网络案件已成功收网，现场查获精品白沙50条、软白沙414条、软芙蓉264条、白沙(硬香槟)45条合计4个品种773条卷烟，抓获涉案人员3人1名涉案人员在逃，目前已刑事拘留1人，案件进入审理深挖中。

4、下一步工作重点：深挖现案，一是开展外围调查取证,锁定证据确;二是督促公安机关加大对涉烟案件嫌疑人的审讯力度，三是进一步挖掘其上线;同时调查其下线卷烟经营户，查证其非法购进、储存、销售“三烟”的行为。

三、加强学习，提升队伍素质。

为“备战”今年专卖管理人员职业技能鉴定工作，全面提高烟草专卖管理人员整体素质，县局高度重视，精心部署，认真组织，一是召开了专题部署会，要求全体专卖人员充分认识到岗位技能鉴定工作的重要性，积极参加培训学习;二是制订了培训学习方案，把《岗位技能鉴定培训教材》各章节内容按工作分工分解到专卖科具体人头，以便开展对口指导;三是下发了学习计划，每周安排学习时间不少于6小时，采取集中与自学相结合、集中培训授课与学习交流相结合、组织摸拟考试与难点问题讨论相结合的办法，强化学习效果。

四、全年安全工作

20xx年通过责任到人、严格管理，全年无一起安全事故发生。

明年专卖管理工作中，我们将针对辖区内非烟有所抬头的问题，从堵源头、斩渠道、挖囤积点、查销售点多方面着手整治全县辖区市场，细心梳理案件线索，侦办好每一起经营案件，争取完成局下达给稽查大队各项目标任务，为*卷烟销售创造良好的市场环境。
