一、位于贡井区长土街沿河路10组76—1号房屋为被上诉人合法拥有。

被上诉人就涉案房屋于1988年9月申请办理了房产证，所有权人为童和平、产权登记为“自权字0017035”号，所有权性质为私有，建筑面积为24.96平方米。以上事实由自贡市国土资源管理局出具的不动产登记查询结果通知书和房屋所有权证存根予以证明，至今，涉案房屋的产权没有做过任何变更，根据《民法典》第十六条“不动产登记薄是物权归属和内容的依据”。故涉案房屋登记在被上诉人童和平名下，被上诉人童和平为涉案房屋的真实权利人。

二、上诉人与被上诉就涉案房屋没有买卖合意，双方之间就涉案房屋不存在买卖关系。

1987年左右，被上诉人为了生活所需，回到了威远县向义镇务农。因涉案房屋与被上诉人的父母的房屋是紧挨着的，故被上诉人将房屋交于其父母进行看管，后于1993年左右上诉人童陆刑满释放回家，因无居所，被上诉人看在兄弟的情份上，把涉案房屋借其居住。后因上诉人在居住该房屋时没有经过被上诉人的允许擅自拆除了被上诉人建于涉案房屋顶上堆放木料的偏间，并侵占了木料，后上诉人与被上诉人发生了争执，上诉人提出赔偿被上诉人的相关损失1000元，双方之间的争执才得以平息。至到20__年上诉人搬离涉案房屋时，也从未向被上诉人表达过要购买此房屋意思表示，被上诉人更没有打算将其房屋卖于上诉人，故双方没有房屋的买卖合意，上诉人与被上诉人之间不存在房屋买卖合同关系。根据《民法典》第十三条“当事人订立合同，采取要约、承诺方式”，及十四条“要约是希望和他人订立合同的意思表示，该意思表示应当符合下列规定：（一）内容具体明确，（二）表明经受要约人承诺，要约人即受该意思表示约束”；《民法典》第六条、第九条、第十四条的相关规定，不动产物权的设立、变更、转让和消灭，应依照法律规定应当登记，未经登记，不发生效力。被告没有转让涉案房屋的意思表示，也不存在房屋的转让登记。

2、上诉人主张于1995年向被诉人支付的1000元是购房款，是明显不成立的。

被上诉人的房屋建造于1982年，当时建造房屋的主要建材是被上诉人花了近一两年的时间打造的石头，在加上其他的建材费和修建时的人工费（价值800元左右），故房屋修建时的造价也不只800元，况且经过长达十多年的时间，若被上诉人要把房屋卖给上诉人，其购房的合理对价是远远超过1000元的。故1000元显然不是涉案房屋的合理对价，不应认定为购房款。

3、上诉人持有被上诉人的房产证和土地使用证，并不能充分说明其是因为购买涉案房屋而取得的。首先上诉人与被上人是亲兄弟，被上诉人把房屋借给上诉人居住是符合人之长情的。其次，被上诉人因长期不在家，把房屋的相关产权证交给其邻居母亲保管也是符合常情的，再次上诉人长期居住涉案房屋，从其母亲手上取得涉案房屋的产权证也是完全可能的。

三、上诉人没有提供合法有效的证据证明与被上诉人之间存在房屋买卖关系，应当承担不利的后果。

（一），上诉人在一审中提供的证人证言不具有真实性和客观性，不能全面真实的还原客观事实。

1、王淑明因年老体弱无法出席法庭，但就王淑明证言真实性有异议，首先：因为王淑明与被上诉人童和平的关系一直都非常僵硬，俗话说皇帝爱长子，百姓爱幺儿，上诉人作为王淑明最小的儿子，因刑事犯罪被判刑，刑满释放回家，经济条件至今较差（原告享受低保和廉租房的事实可以印证），故王淑明偏心痛爱小儿子，维护小儿子做歪曲事实的证言具有高度的可能性，王淑明年纪较大视听和记忆功能都大大的降低，同时王淑明老人的精神状态和健康状态令人担忧，其主观意识容易受他人左右，故其证言的可信度较低。再次因王树明无法出席法庭，其证言又无其他证据予以印证，故缺乏真实性。

2、童树槐的证言不能客观反映事实真相，其证言不能证明上诉人与被上诉人之间存在房屋买卖关系，因为其并没有亲身经历感知事实的经过，只是听王淑明说的，其证言属于传闻性的、推测性，不具有客观真实性。

3、童玉仙的证言不能如实反映客观事实，童玉仙述称其只记得原告出了1000元钱给被告购买房屋，但却不能述清楚事件发生的具体时间、事件发生的原因，而且当时连涉案房屋由谁居住都不清楚，故其自称原、被告买卖房屋是亲自在场缺乏真实性。

4、童玉梅的对当时上诉人与被上诉人之间是否具有涉案房屋的买卖关系，其并没有亲身经历过，所做的证言具有传闻性和推测性不符合客观实际情况，同时童玉梅在不在场情况下对1995年上诉人与被上诉发生争执的经过陈述的过于详细，显然是不符合客观实际，其陈述的证言不具有真实性。

（二）上诉人至今都享有自贡市贡井区的廉租房住房补贴，其给行政机关提高的档案材料中出具了上诉人与被上诉人的房屋租赁合同，此证据充分证明了上诉人与被上诉人之间没有房屋买卖关系，只有房屋租赁合同关系。

四、上诉人捏造房屋买卖的事实，其主要目的是获取该房屋的拆迁安置补偿费。

因涉案房屋要被政府进行拆迁，上诉人想着被上诉人离家多年，户籍也迁走了，上诉人又居住涉案房屋多年，故上诉人想独自侵占该房屋的拆迁安置补偿费，曾多次找被上诉人协商，被被上诉人拒绝。故上诉人许诺童玉仙、童玉梅、童树槐以经济利益，让其提供伪证，捏造房屋买卖的事实，想从中谋取利益。上诉事实由上诉人也亲口述说，如果被上诉人在现在承诺把房子卖于上诉人，上诉人可以分一部钱给被上诉人，但被被上诉人断然拒绝，其可以合理的推测出上诉人与各证人之间有恶意串通，损害被上诉人合法权益之嫌疑。

故综上所述，涉案房屋的所有权归属于被上诉人，上诉人与被上诉人之间没有房屋买卖合同关系，恳请法院驳回上诉人的诉讼请求。

3、“私贷公用”情况下当事人的确定。 实践中有些地方出现“私贷公用”的情况，所谓“私借公用”是有的“公”即企业，由于已经有逾期贷款未还等原因而不能贷款，于是便由个人或私营企业以自己名义代为贷款，所贷款项由企业使用。这就是所谓“私贷公用”。私贷公用以民法典的规定，应该属于委托关系。在这种情况下，出借人为原告没有异议。如何列被告，应考虑以下情况：

(1)出借人不知道贷款人是企业，贷款后贷款人也未披露企业用款情况，企业也未主动介入还款事宜的，应以借款人为被告;
